The Press and Publication Rules, 2049 (1992) Publication in Nepal Gazette
2049.5.8 (24 August 1992)
In exercise of the power conferred by Section 39 of the Press and Publication Act, 2048 (1991) Government of Nepal has framed the following Rules.

(1) These Rules may be called as “The Press and Publication Rules, 2049 (1992).”
(2) These Rules shall come into force immediately.

2. Definitions: Unless the subject or context otherwise requires, in these Rules:-
(a) “Act” means the Press and Publication Act, 2048 (1991).
(b) “Director General” means the Director General of the
⇔Department of Press and Information of Government of Nepal.

3. Press to be Registered:

A person who desires to operate printing press pursuant to Sub-section 3 of the Act shall submit an application to
the Local Authority in a format as referred to in Schedule-1.
(2) Upon receiving an application pursuant to Sub-rule (1), the Local Authority shall issue a certificate in order to operate the press to the applicant in a format as referred to in Schedule-2 upon charging One Thousand Rupees as fees.

(3) The Local Authority shall maintain details of record in the Press Registered Book as referred to in Schedule-3 upon issuing the certificate pursuant to Sub-rule (2).

4. Newspapers and Magazines to be Registered:

(1) A person who desires to publish any of the following newspapers and magazines pursuant to Section 7 of the Act shall submit an application in a format  as referred to in Schedule-4 to the Local Authority along with the
following fees:-
(a) For daily newspapers Rs. 1000/-
(b) For half-weekly newspapers Rs. 700/-
(c) For weekly newspapers Rs. 500/-
(d) For half monthly newspapers Rs. 300/-
(e) For monthly and other newspapers Rs. 200/-
(f) For other newspapers and magazines Rs. 200/-
(2) Upon receiving an application pursuant to Sub-Rule (1), the Local Authority shall issue a temporary certificate to publish the newspapers and magazines to the applicant in a format as referred to in Schedule-5.
(3) Upon receiving an approval to issue a permanent certificate for publication of newspapers and magazines by the Press Registrar pursuant to Sub-section (4) of Section 7 of the Act, the Local Authority shall issue a permanent certificate to publish the newspapers and magazines to the applicant in a format as referred to in Schedule-6.

(4) The Local Authority shall maintain details of record in the Newspapers and Magazines Registered Book as referred to in Schedule 7 upon issuing the certificate pursuant to Sub-rule (3).
(5) If someone submits an application pursuant to Sub-rule (1) for the registration of newspaper and magazine which does not require to be registered pursuant to the proviso of Section 7 of the Act, the Local Authority shall also register such newspaper and magazine. Provided that;
(a) The fee required to pay pursuant to Sub-rule (1) shall not be charged to the newspapers and magazines registered in this manner.
(b) The provisions relating the qualifications of Rule 15 shall not be applicable to the editor of the newspaper and magazine registered in this manner.

(1) A person, who obtains the ownership of the publication of newspapers and magazines by virtue of transfer pursuant to Section 8 of the Act, shall inform to the Local Authority of such transfer in a format as referred to in Schedule-8.
(2) The Local Authority shall maintain the information in the Registered Book as referred to in Schedule-7 upon receiving information pursuant to Sub-Rule (1).

(1) In the top of the first page of newspaper and magazine, the registered number given by the Local Authority, name of the newspaper and magazine, type, year, volume, date, and price of the newspaper and magazine and in
every page of the newspaper and magazine, its name of publication date  shall be required to be mentioned clearly.
(2) In the bottom of the last page of the newspaper and magazine or in the top of the editorial column, the name of the publisher, editor, printer and press shall be required to be mentioned clearly.

(1) The following newspaper shall publish at least in the following size and page numbers.
(a) For daily newspaper in size of 12″x24″ and at least 4 pages
(b) For half-weekly and weekly newspaper in size of 10″x15″ and at least 6 pages
(c) The half-monthly, monthly, bi-monthly and quarterly newspaper in size of 9″x15″ and at least
12 pages.
(2) The publisher shall publish the following newspapers in the following number at least within Six months:
(a) Daily newspaper 150 issues
(b) Half-weekly newspaper 40 issues
(c) Weekly newspaper 20 issues
(d) Half-monthly newspaper 10 issues
(e) Monthly newspaper 5 issues
(f) Bi-monthly and quarterly newspaper 2 issues

If someone requests in relation to the details of any newspaper, in order to give advertisement to such newspaper and magazine the Press Registrar may provide the details of such newspaper and magazine upon charging One Hundred Rupees as a fee.

(1) A Nepali or foreign organization obtaining press or communication shall submit the details of its representative working within Nepal to the Director General in a format as referred to in Schedule-9.
(2) A person who desires to obtain a certificate of the press representative or temporary press representative shall submit an application to the Director General along with the recommendation of the working organization and certificate of qualification pursuant to Rule 15 in a format as referred to in Schedule-10
Provided that, the foreign citizen who desires to obtain the certificate of a press representative or temporary press representative shall not require to submit the certificate of qualification.
(3) Upon receiving an application pursuant to Sub-rule (2), the Director General shall make necessary inquiry and forward the application to the Ministry of Communications, Government of Nepal along with his/her opinion.
(4) Upon receiving an application pursuant to Sub-rule (3), Government of Nepal, Ministry of Communications may allow to issue a certificate to the applicant as per the request.
(5) If the Ministry of Communications, Government of Nepal allows to issue a certificate to the applicant pursuant to Sub-rule (4), the Director General shall issue a certificate of press representative or temporary press representative to the applicant upon charging the fee pursuant to Rule 12 in a format as referred to in Schedule-11.

10. Provisions Relating to the Freelance Journalist:

(1) A person who desires to obtain a certificate of freelance journalist shall submit an application to the Director General along with the certificate of qualification pursuant to Rule 15 in a format as referred to in Schedule 12.

(2) Upon receiving an application pursuant to Sub-rule (1), the Director General shall forward the application to the Ministry of Communications, Government of Nepal of Nepal along with his/her opinion.
(3) Upon receiving an application pursuant to Sub-rule (2), Government of Nepal, Ministry of Communications may allow to issue a certificate of freelance journalist to the applicant as per the request.
(4) If Government of Nepal Ministry of Communications allows to issue a certificate to the applicant pursuant to Sub-rule (3), the Director General shall issue a certificate of freelance journalist to the applicant upon charging a fee pursuant to Rule 12 in a format as referred to in Schedule-13.

(1) The certificate issued pursuant to Rule 9 or 10 shall be valid for a period of up to Three fiscal years.
Provided that, the certificate of temporary press representative shall be valid only upto the time period for which it was issued.
(2) An application shall be submitted to the Director General to renew the certificate within Thirty-Five days after expiry the validity period of the certificate pursuant to Sub-rule (1) in a format as referred to in Schedule 14 along with Fifty Rupees as a renewal fee.
(3) If someone submits an application to renew the certificate after expiry of the validity period pursuant to Sub-rule (2), the Director General may renew the certificate upon charging the additional fee mentioned as follows including a fee as referred to in Sub-rule (2) :-
(a) Up to a period of Three months of date of expiry pursuant to Sub-rule (2) Rs.50/-
(b) Up to the end of Ashad month (about mid July) from the date of expiry pursuant to Clause (a) Rs 150/-
(4) If the certificate is not renewed within the period as referred to in Sub-rule (3), such certificate shall ipso facto be cancelled.
(5) A certificate obtained by a foreigner pursuant to these Rules  shall not be renewed more than twice.

(1) The following fees shall be charged to obtain a certificate pursuant to Rule 9 or 10:
(a) Press Representative:-
(1) For Nepalese Citizen Rs. 300/-
(2) For Foreign Citizen Rs. 1500/-
(b) For temporary press representative Rs. 900/-
(c) For freelance journalist Rs. 600/-

(1) A Nepalese Citizen who has obtained a certificate of press representative or freelance journalist may
collect the news throughout Nepal.
(2) A foreign citizen who has obtained a certificate of press  representative or temporary press representative may collect the news only within the area as prescribed in the certificate.

14. Designation of the Court: The concerned Court of Appeal has, hereby, been designated for the purpose pursuant to Section 32 of the Act.

15. Qualifications of the Editor, Press Representative and Freelance
Journalist:

The following qualifications shall be required to be an editor, the press representative or the freelance journalist:
(1) To be an editor:
(a) One who has passed a Bachelor’s Degree or equivalent from the educational institute recognized by Government
of Nepal, or
(b) One who has passed the School Leaving Certificate from the educational institute recognized by Government of
Nepal and has worked at least Ten years in relation to news collection and editing in any news based daily, half weekly, weekly or half-monthly newspaper or magazine.
(2) To be a press representative or a temporary press representative:
(a) One who has passed the School Leaving Certificate from the educational institute recognized by Government of
Nepal, or
(b) One who has worked at least Five years on news collection and reporting.

(3) To be a freelance journalist:
(a) One who has passed a Bachelor’s Degree on journalism from any educational institute recognized by Government
of Nepal and has worked for a period of up to Ten or more than Ten years in editing or column writing in the
newspaper and magazine.
(b) One who has passed a Bachelor’s Degree or equivalent from any educational institute recognized by Government
of Nepal and has worked for a period of up to Fifteen or more than Fifteen years in editing or column writing in
any newspaper or magazine.

(1) No person other than the concerned person shall use the certificate issued pursuant to Rule 9 or 10.
(2) If anyone abandons to represent the concerned organization or newspaper, the person or the manager or the editor of the concerned organization shall give a notice to the Director General within Seven days and return the certificate.

While classifying the newspapers and magazines Government of Nepal, Ministry of Communications shall, for the purpose of assistance or facilities to be given to the newspapers and magazines registered pursuant to this Act, classify on the basis of the reports submitted by the Office of Press Registrar and Press Council.

18. Alter in Schedule: Government of Nepal may alter the Schedules of these Rules as per necessity by a Notification published in the Nepal Gazette.

19. Repeal: The Press and Publication, 2040 (1983) is, hereby, repealed.
