Ship Registration Rules, 2028 (1972)

In exercise of the powers conferred by the Section 29 of the Ship Registration Act, 2027 (1971) the Government of Nepal has made the following Rules.
1. Short Title & Commencement
(1) These Rules may be called “Ship Registration Rules, 2028 (1972)”.
(2) These Rules shall come into force from the date of publication in Nepal Gazette.
2. Definition
2. Definition : Unless the subject or context otherwise requires in these Rules.
(a) “Act” means Ship Registration Act, 2027 (1971).
(b) “Office” means the Nepal Ship Office established pursuant to Sub-section (3) of Section 4 of the Act.
3. Application To Be Submitted
(1) A person or body desiring to register any ship shall submit an application to the office in the format
prescribed in Schedule – 1.
4. Registration Fee
4. Registration fee : Along with the each application to be submitted pursuant to Rule 3, the fees prescribed pursuant to Schedule – 2 also shall be attached.
5. Person Allowed/competent To Submit An Application
(1) The application to be submitted pursuant to Rule 3, shall be submitted by making signature of any person mentioned as follows :
(a) If the ownership of such ship has with only one person then the person or his/her authorized representative or agent, or,
(b) If the ownership has with more than one person, then all such person or authorized representative or
agent of persons, or
(c) If the ownership has with any corporate body then the directors of such body corporate or if the board
of directors has delegated the power to any director or person then such authorized representative.
(2) If the authorized representative or agent has been applying pursuant to Sub-rule (1), he/she shall also submit the power of attorney or authorization letter received by them.
6. Details Of Ownership
6. Details of ownership : Along with each application submitted pursuant to Rule 3, the details of ownership also shall be submitted in the format prescribed in Schedule-3.
7. Certificate Of Manufacture
The certificates relating to the manufacture of ship issued (provided) by the company which has manufactured the ship, also shall be submitted along with the application to be submitted to register any newly built ship.
8. Documental Evidence Of A Ship Being Registered Anywhere To Beâ submitted
If any ship that has being registered in any other country (abroad) has to be registered as a Nepalese ship then the documental evidence (slip) related to the prior registration of that ship and the written documents of receive of ownership of such ship to the person registering it also shall be submitted while making an application.
9. Certificate Related To Tonnage
The latest international tonnage certificate issued in relation to ship, according to the treaty (agreement) document related to the tonnage measurement of ship held in also in 1947 A.D., also shall be submitted along with the application to be submitted for the registration of the ship.
10. Name Of The Ship
(1) The purposed name of the ship also shall be mentioned in the application to be submitted for the registration of any ship.
(2) If the purposed name pursuant to Sub-rule (1) has being similar with name already provided to the other ship or deemed (proved) inappropriate to give such name with the view of national interest, by the registrar, he/she may ask to make a propose for another name instead of that name.
(3) If the name purposed pursuant to Sub-rule (1) and (2) has been approved, the ship shall be registered with the name.
(4) The name provided to a ship pursuant to this Rule shall not be provided to any other ship even the registration of that ship has been cancelled by any reason.
Provided that, This Rule shall not prohibit to give the previous name for applying to register the same ship which registration has been canceled by any reason.
11. Format Of Registration Book
11. Format of Registration Book : The format of the registration book for Nepalese Ship shall bas as prescribed in Schedule – 4.
12. Registration Of Ship And It’s Certificate
(1) The registrar shall make registration of a ship in the registration book of Nepalese ship if it deemed appropriate while making inquiry examination of the received application and documents received to register any ship.
(2) Upon registration of a ship pursuant to Sub-rule (1), A certificate registration shall be issued as prescribed in Schedule-5 by taking the Fifty Rupees fee.
13. The Certificates Submitted For Registration To Be Kept In Theâ office
If any ship has been registered pursuant to Rule 12, the original certificates, receipts and documents submitted pursuant to Rule 7, 8 and 9 in relation to the registration of a ship shall be kept in the office.
14. The Provisional Certificate Of Nationality Have To Be Received
14. The provisional certificate of Nationality have to be received :
(1) In the situation pursuant to Clause (a) of Sub-section (1) of Section 16 of the Act, the person eligible to apply for certificate of Nepalese Nationality shall submit an application to the nearest Nepal consulate or diplomatic office in the format prescribed in Schedule-6.
(2) Fifty Rupees or local currency of equivalent value shall be submitted along with the application to be submitted pursuant to Sub- rule (1).
(3) If the description mentioned in the application submitted pursuant to Sub-rule (1) has been proved true, the concerned consulate or diplomatic office shall issue a provisional certificate of Nepalese Nationality to such ship as prescribed in the Schedule-7.
(4) The Nepalese consulate or diplomatic office which issued a provisional certificate of Nationality pursuant to Sub-rule (3) shall give the information of issuance of such certificate to the office as soon as possible.
15. Serial Number Of Registration
For the identity of each Nepalese ship to be registered pursuant to Rule 12, the ship shall be registered by
maintaining serial number containing numbers or letters or both and according to such serial.
16. Registered Name To Be Written In The Ship
(1) The registered name of a ship and also the place or registration, shall be written in each Nepalese ship in the Devnagari and Roman script in the specified place pursuant to Sub-section (3) of Section 19 of the Act, with white oil color in the place background.
(2) The shape of each letter to be written pursuant to Sub-rule (1) and measurement of mutual spacing shall be as prescribed by the registrar.
Provided that, The shape and size of letters of the name shall be clearly larger than the shape and size of the letter related to the place of registration the shape and these letters shall no less than ten centimeter in width and
forty centimeter in height.
(3) The letters to be written in the ship pursuant to this Rule, shall be written in the boats and dingoes, that has to be remain along with the ship, in the same ratio as that has been written in the ship.
17. Change (alteration) In The Name Of The Ship
(1) If the name of any ship given at the first time for registration has needed to be changed, then the owner of the ship shall submit an application clearly mentioning the reason for such change to the office along with Ten Rupees fee.
(2) If the ship which name has desired to be changed, has been in mortgage or in any charge or in restriction then the approval (consent) of such creditor taking the mortgage or other concerned person also shall be submitted along with such application.
(3) If such change in the name deemed appropriate, upon inquiry/examination made by the registrar on the application submitted pursuant to Sub-rule (1), he/she shall give the approval by mentioning such description in the registration book and certificate.
18. Alteration In Other Details
(1) If an alteration has made in the tonnage, category (class) or any other details of the ship, the owner of the ship shall submit an application to the office within one month of such alteration.
(2) In the application to be submitted pursuant to Sub-rule (1), the details of, type of alteration has been made in any things, has to be mentioned clearly.
(3) If it deemed appropriate in the inquiry or examination made on the application after being received pursuant to Sub-rule (1), by the registrar, he/she shall issue another certificate of registration again, by mentioning the details of such alteration in the registration book, canceling the prior certificate of registration and taking the fifty rupees fee
19. Alteration (change) In Ownership To Be Informed
(1) In the situation pursuant to Section 22 of the Act, the ownership of any person mentioned in the details related to the ownership submitted pursuant to Rule 6 has been transferred in other person by any reason, then the person receiving such ownership shall give the information relating to it, to the office.
(2) After receiving the information pursuant to Sub-rule (1), and upon making the required inquiry by the registrar if, there has not seen any obstacle (problem) to make the ownership registration in the name of the person submitting such information then the registrar shall mention the name of the concerned person in the ownership folio of the main registration book and the certificate of registration.
20. Inspection Of Registration Book
20. Inspection of registration book : The person desiring to observe the registration book of ship shall submit an application before the registrar, attaching the five rupees fee and the registrar may make observation in his/her presence to him/her within the office time.
21. Provisional Certificate To Be Taken, If Registration Certificate Hasâ been Lost
(1) If the registration certificate of any Nepalese ship has been lost, damaged or any alteration has been made in the details mentioned in such certificate pursuant to Clause (b) of Sub-rule (1) of Rule 16 of the Act, than the master of the ship shall submit an application also mentioning the reason, in the nearest Nepalese consulate or diplomatic office.
(2) Fifty Rupees or local currency of equivalent value as the fee shall be submitted along with the application submitted pursuant to Sub- rule (1).
(3) If the description mentioned in the application submitted pursuant to Sub-rule (1) has been proved appropriate (reasonable) the concerned consulate or diplomatic office shall issue a provisional certificate of Nepalese Nationality pursuant to Rule 14.
22. Name Of The Corporate Body Operating The Ship To Beâ registered
(1) Any corporate body desiring to operate the Nepalese ship that has been in it’s own ownership or taken in the lease, shall register it’s won business in the office, also attaching the copy of certificate of registration, registered as a corporate body. The corporate body not registered as such, shall not be allowed to operate the ship business.
(2) Any corporate body which has not registered it’s own business to operate the ship business pursuant to this Rule, shall not be provided the special facilities (privileges) related to the development of ship business and granted by the Government of Nepal in time to time.
(3) To register the business pursuant to this Rule an application shall be submitted in the format prescribed in Schedule-8 and if such body corporate has achieved (deserve) the qualification pursuant to Section 28 of the Act, then a certificate as prescribed in Schedule-9 shall be issued.
23. Information (notice) On Charge And Restrictions To Beâ provided
(1) The ship which has been registered or presented for making registration pursuant to these Rules, if has been given in mortgage or kept in such a way that making a restriction on the right of the owner of the ship by any other similar documents or has been granted or maintained or restricted the right mentioned in Sub-section
(1) of Section 12 of the Act, the notice shall be given to the office along with the application submitted to register the ship or within thirty days from the happening of such events.
(2) The charge or restriction mentioned in Sub-rule (1) shall be prepared in written form and such document also shall contain the valuation number of charge or restriction. The attested copy of that document also has to be submitted (presented) along with such notice.
(3) The registrar shall keep the information received pursuant to this Rule in the folio of charges or restriction of registration book mentioning in chronological order. Out of such charges and restrictions, if the question has been raised on the priority of similar matters then it shall be maintained (settled) according to the chronological order
mentioned in that folio.
(4) If the ship registered pursuant to this Rule has been taken for any purpose by mortgage or contract then the person who has taken it in such mortgage or contract shall not have any right on ownership of the ship and he/she shall not have right to sell the ship or right to transfer (handover) it in any way except with the approval of the registrar.
(5) After the end of any charge or restriction in relation to any ship, mentioned in the concerned folio of the registration book, the notice of such matter shall be given to the office as soon as possible, and after receiving such notice registrar shall mention such matter in the concerned folio of the registration book.
24. Registration Of A Boat
(1) The owner of the boat shall submit an application to register each boats that has to be registered pursuant to Section 7 of the Act to the office in the format prescribed in Schedule- 10.
(2) The Fifty Rupees fee shall be submitted along with the application to register the boat pursuant to Sub-rule (1).
(3) If the registrar has seen that it has been appropriate to register the ship after making an inquiry/examination on the application submitted pursuant to Sub-rule (1), he/she shall register that ship in the registration book of boats in the format prescribed by Schedule-11 and shall issue a certificate in the format prescribed by Schedule -12.
25. The Identity Mark /sign Of The Boat
(1) As an identity mark of each Nepalese boat that has to be registered pursuant to Rule 24 number, or letter or both shall be listed in an order and shall be registered in the registration book.
(2) The identify mark/sign that has been registered for the identity of a boat shall be written in each Nepalese boat in such away that it can be clearly seen from right and left.
26. The Other Provisions Of The Rules To Be Prevailed
26. The other provisions of the Rules to be prevailed : The provisions mentioned in case of the ship in Rule 8, 17, 19, 20 and 23 of these Rules shall prevail as such, in case of boat too
27. Appointment Of Inspectors And Employees
(1) To classify and for performing the job to submit a report to the office after making an inspection of the Nepalese ship or boats that has to be registered pursuant to these Rules the Government of Nepal may appoint navigation Inspectors in required number, types and having such qualification.
(2) The Government of Nepal shall give recognition to the certificates of classification issued by any international classification society in relation to the ships or boats that has to be registered pursuant to these Rules, until the navigation inspector or employees has been appointed pursuant to Sub-rule (1).
28. The Forms In English Language Also To Be Used
The registrar may made prepare the forms and certificates of Schedules of these Rules by keeping authorized translation of English Language of Roman script also with the Nepalese language of Devnagri script.
