Drama House (Rent Control) Rules, 2017 (1961)
The Government of Nepal, having exercised the power conferred by Section 2
of the Administrative Procedure (Regulating) Act, 2013 (1956), has enacted the
following Rules:-
1. Short Title and Commencement:
(1) These Rules may by called ” Drama House (Rent Control) Rules, 2017 (1961).
(2) These Rules shall come into force immediately.
2. Definition: Unless the subject or context means otherwise, in these
Rules,-
(a) “Stage” means the Singhdurbar Drama House and the goods also, remaining therein.
(b) “Prescribed Officer” means the official specified by the Government of Nepal for that purpose.
3. License to be Obtained:
A person intending to make a show of drama in the drama house shall submit an application in due process by clearly mentioning the following matters before seven days of the show of drama to the prescribed official:-
(a) Whether it is a ticket show or free show for cultural promotion, or
(b) Whether it is to be exhibited for the purpose of collection of fund for a public organization or social activity, or
(c) Whether it is a ticket show for enterprise or entertainment, and
(d) Duration and time of exhibition of the drama.
4. Licence to be Issued:
The prescribed official, in the situation of application under rule 3, may issue a license for the specified time
subject to rule 5.
5. Rent to be Taken:
The recipient of license under rule 4 shall pay the rent at the rate of Rs. 50.00 per day to the prescribed official.
Provided that- (a) No rent shall be levied for a drama to be exhibited without ticket for the purpose of cultural promotion or collection of fund for a public organization or social activity.
(b) Rent at the rate of Rs. 25.00 only per day shall be levied for a drama of ticket show exhibited for cultural promotion.
(c) 50 percent of the amount of rent supposed to be paid under sub-rule (1) shall have been paid prior to obtaining the license and the remaining amount shall have been paid within seven days of termination of show of
drama.
6. Termination of Licence:
(1) Notwithstanding anything written in these Rules, the Government of Nepal, if deemed necessary, may change
the duration and time of a license or postpone or cancel a license.
(2) Not any rent shall be levied for a license cancelled under sub- rule (1).
7. Security of Drama House:
In a situation of embezzlement or loss of drama house or any goods thereof, the person making and causing to
make show of the drama shall have been the responsibility.
8. To be carried on under These Rules:
Matters set forth in these Rules shall be carried on in accordance with these Rules and other matters shall carried on in accordance with the prevailing law.
9. To be Believed by the Prescribed Official :
No exemption shall be made in the rent under these Rules unless the prescribed official believes that the drama which is said to be exhibited for cultural promotion is actually for the promotion of culture.
